The fate of Thousands of Students who have already completed their degrees or are enrolled in courses run by Study centres of out side Universities now hangs in doldrums.The scenario of higher education in Jammu and Kashmir needs to be revised because it does not cater to the needs of the poor aspirants. University recognized by UGC, stand automatically recognized for the purpose of employment if approved by Distance Education Council (DEC) throughout the country including state of Jammu and Kashmir (Gazette of India 8th April 1995 MHRD Govt. of India) published in Greater Kashmir 18th. Sep-2008/Rising Kashmir/State Times/Kashmir Times etc where was the J&K Government when such notifications, advertisements, Articles where seen in leading news papers of Jammu and Kashmir why any one from the State Govt. was not coming forward to close these study centres why any action was not taken against persons who where involved in running such centres At that time. According to UGC notification all the degrees awarded through distance mode should be accepted as equivalent to Regular degrees if Approved by DEC For running programmes in distance mode the approval of joint committee UGC-AICTE-DEC is required DEC is the coordinator of joint committee. Universities can run some of the Science/Technical/Professional courses through distance mode if approved by joint committee UGC-AICTE-DEC
The Distance Education Council accords recognition to the Universities / Institutions to offer programmes through Distance Mode and it is for the Statutory bodies of the Universities / Institutions concerned to decide what programmes to be offered through distance mode.
Joint committee in itís 35th meeting decided that the territorial jurisdiction for distance education programmes. The council resolved that Distance Education and on-line Education cannot have the territorial jurisdiction and in case of central universities and state universities the territorial jurisdiction` shall be as per the act, statutes and distance education regulations of the respective universities for all their programmes.
If universities of Jammu and Kashmir are recognized by same UGC/AICTE/DEC and are member of same AIU than how their degree is valid and those who have acquired degrees through outside universities is invalid. We have done degrees from UGC/AICET/DEC /AIU approved universities
If their was ban on distance education study centres of out side universities In Jammu and Kashmir Than way they operated normally with out any problem in Jammu and Kashmir till July 2009. They were making admission by publishing Big Advertisements in leading news papers of Jammu and Kashmir. Where was the Govt. Till July 2009. What about those students who have done their degrees through distance mode through main campus of the universities for e.g Annamalai University which does not have study centre/admission centre in J & K many of the students have done their degree through Annamalai University main campus not through study centres.
It becomes confusing for the student community to understand the policy of government. If those universities are not recognized by these esteemed organizations they are liable for closure at an earliest. But the universities come under the preview of UGC and if the university runs some distance education programme, the distance education council (DEC) has the authority to issue recognition otherwise the programmes canít be valid. The recognition policy of the DEC says in its clause (v) regarding the territorial jurisdiction. the distance education council has decided not to insist on territorial jurisdiction to be followed by institutions in offering programmes through distance and online modes and on that matter, universities should be governed by their own acts and status and in clause (vi). Approvals to study centres : the DEC does not consider giving approvals to study centres of any distance education institution as opening of study centres and regional centres is an internal policy matter of the institution/ university concerned, as per the provision in their own act /statutes.
Why SSRB, School Education Department, PSC accepted all the degrees through distance mode, interviewed them and recruited many among them in different Govt. Departmentís till end of 2009.Till end of 2009 PSC/SSRB used to say that we accept all the degrees through distance mode why the deceived many students. What about those students who where in a big Hope that their degrees are accepted by SSRB, PSC, School Education Department and other Recruiting Agencies. We were shocked when We they came to know that PSC, SSRB ant other recruiting agencies will not accept our degrees now . Why the list of unauthorized institutions in J & K was not published Till July 2009 what about those students who have already completed their courses or are presently getting education from these centres.Which forces from State Government where baking this process. What will be the future of these students what thay will do now by end of 2009 thay were knowing that their degrees are recognized by State Government but now where thay go some of them have crossed age of 30 and some are near to 37 what will thay do. At this time State Govt. is not considering SRO-339 Which gives relaxation to such sutudents who have either completed or already enrolled in such centres. Govt Should give one time relaxation to all those students who have either completed or have got admission before July 2009. Large number of students who have acquired their degrees have moved to High Court for justices and among them are such students who can not afford to fight for justices.
There are limited seats in universities of Jammu and Kashmir some of the students have resources they go outside for regular education but some have limited resources they choose the way of Distance Education There are many courses which are not offered by universities of Jammu and Kashmir ,IGNOU,DOEACC there remains no option for the students to get admission through Outside Universities.
The universities of Jammu and Kashmir should get the approval for many courses and start them in their distance education department and should open their own study centres across the state so that the students who will not get chance to get the regular higher education will be able to get higher education through distance mode of their own universities.
Who is responsible State Government, Study Centres or Students? State Government should give One time exemption to all the students who have either completed or have joined the courses before the July 2009. There Degrees should Be accepted by PSC, SSRB, Higher Education Department, School Education department and other recruiting agencies.
Present Young Chief Minister/ Higher Education Minister/ Education Minister/Director/Secretary Higher Education Department/Chairman PSC/Chairman SSRB/Director Education Department should look into the matter and should give on time relaxation to all such students.
